Private Hire Driver Conduct Hearing- (Reference 01-16)

The Following is a Part 1 summary of the case:

 

The Licensing Sub-Committee was asked to consider whether Hackney Carriage Driver (Reference 01-16) was a fit and proper person to hold a Hackney Carriage licence in Slough. The Driver was represented at the hearing and also attended in person.

 

The Licensing Officer summarised the background to the case and discussed the relevant Policy and Legislative considerations. She advised Members that the Sub-Committee could only allow an Applicant to hold the a Licence if it was satisfied that the applicant was a ‘fit and proper’ person to do so.

 

The Sub-Committee was advised that the Applicant had failed to disclose an offence that was committed in 2013. In the circumstances the application was referred to the Licensing Sub-Committee for determination.  The Licensing Officer submitted that, in light of his failure to declare the conviction, the Driver was not deemed to be a fit and proper person to hold a Hackney Carriage licence in Slough and recommended that his licence be revoked.

 

The Committee was reminded that it had the power to revoke, or suspend the Licence, Issue a Warning or take no further action.

 

The Driver conceded that he had failed to notify the Licensing Office of his conviction but argued that apart from the incident of the assault which was not related to his employment as a driver, there had no been complaints since which affected his ability to hold a licence.

 

The Sub-Committee adjourned to reach its decision and carefully considered  the evidence.

Resolved -  That the Hackney Carriage Driver’s (ref 01-16) Licence be suspended for a period of 3 months and that a warning be placed on his file.
