The Deprivation of Liberty Safeguards (DoLS) came into force on 1 April 2009. The safeguards provide a legal framework for Local Authorities and Primary Care Trusts to authorise the deprivation of a person’s liberty if it is deemed to be in their best interests such as to protect them from harm.
The safeguards will only apply to those adults who lack capacity to decide about their care and treatment and who are resident in either a care home or a hospital.
The safeguards will not apply to adults detained under the Mental Health Act 1983 as there are safeguards already in place for this vulnerable group.
