What is the councils policy on rent arrears?
It is the councils policy to take prompt, firm but fair action against tenants who do not pay their rent or who fail to keep to an agreement to repay their rent arrears. This has proved to be of the most benefit to both tenants and the Council.
What is your recovery procedure?
We have a strict arrears recovery procedure which the rent recovery officer will follow. The first stage is for us to write to you asking you to clear the arrears. If we get no response, we will write again warning that legal action will be taken if you fail to respond. If we still do not get an appropriate response, we will serve a Notice of Seeking Possession. This is the first stage of legal proceedings.
What will happen if I do not make an arrangement to repay the arrears?
The council can commence legal proceedings in the county courts which can eventually lead to you being evicted from your home.
Why have I received a notice of seeking possession?
A notice seeking possession is served if you have arrears in your rent and you have not made any attempt to contact the council in order to agree a repayment of the amount outstanding or have failed to keep to such an agreements.
Will I still be responsible for the arrears after my eviction?
Yes you will still remain responsible for the arrears and the council will continue to pursue the arrears. You will not be eligible to join the housing register whilst your arrears remain unpaid.
I want to terminate my tenancy agreement, what do I do?
If you want to end your tenancy, you must give us 4 weeks notice in writing and ensure your rent is paid up to the date of termination.
I have large rent arrears, will the amount be taken into account when you move me?
You would not be allowed to move into another council property until the arrears had been cleared. Please contact the allocations department on 01753 875541 for further advice.
I am in arrears with my rent - What happens when the case goes to Court?
At the court hearing we will usually request a suspended possession order on condition that you pay your current rent plus an amount towards clearing the arrears.
How do I assess my financial position?
To help you assess your financial situation we can provide you with a form on which you must record all your income and expenditure. By taking your expenditure away from your income you can assess how much under or overspend you have each week or month. A leaflet and the form is available from the council.
