What noise legislation is there?
This is covered by the Environmental Protection Act 1990.
When are people allowed to carry out building work without causing a noise nuisance?
Building work can be carried out at any time, unless it is noisy. For noisy operations, 08:00-18:00 Monday to Friday and 08:00-13:00 on Saturday and no time on Sunday and Bank Holiday. There are exceptions, for example for emergency repairs or certain cases on highway. For DIY, chat with your neighbours before carrying out the work, to get their agreement for timing.
When is noise nuisance a statutory nuisance?
It will be a statutory nuisance, if it affects the material comfort of the home. If you have to turn up the TV more than normal to hear it, then it is very likely that it is a statutory noise. Before reporting to the council, please chat with your neighbour first, so that you can have a mutual solution to this.
