What is a penalty notice in relation to pollution?
If you experience a nuisance in this context such has emissions of smoke, fumes or gases, dust, steam and smell from a premises that affects your enjoyment or use of another premises then the council must take reasonable steps to investigate and, if appropriate, to take formal action to in the event of justified complaints of statutory nuisance.
This is in accordance with Part 3 of the Environmental Protection Act 1990. If the complaint is upheld then the person making the nuisance could be served with the penalty notice/fine. Typically this covers smoke and ash from garden bonfires, smoking chimneys, dust from building and demolition activity. It does cover cooking smells from restaurants but not from arising from domestic premises.
