Sex establishment licences

When considering an application for a sex establishment the council may only use the following criteria:

• the suitability of the applicant
  
• whether the applicant will carry on the business for the benefit of another person who would be refused a licence if he made the application themselves
  
• the character of the relevant locality where the premises are to be situated
  
• whether the number of sex establishments, or sex establishments of a particular kind, in the relevant locality at the time is appropriate for the locality. Nil may be the appropriate number and the council has resolved that the relevant locality shall be the 'ward' in which the premises are to be situated.
