Appointee and Deputyship

Accessing the Service

Access to this service is available by referral only through a social worker.

The social worker will:

  • Carry out a mental capacity assessment to determine whether the person is unable to manage their financial affairs
  • Provide medical evidence to support this assessment
  • Submit a full overview of the person’s financial information with the referral.

What happens next?

Once received the Appointee and Deputyship Service is able to provide advice on which option best meets the individual’s needs:

  • Deputyship application: to the Court of Protection (COP) if the person has property, savings, or other sources of income
  • Appointeeship application: to Department of Work and Pensions (DWP) when the person’s sole income consists of state benefits and there is no property to manage.

Once the application to either the DWP or COP is approved, the service will:

  • Provide ongoing professional financial management
  • Act as an advocate on behalf of the individual
  • Manage the financial affairs of adults who lack capacity and have no one else to represent them.
